Terms of Service

These terms govern your use of the onboard Wi-Fi service (version 2).

SeaDream Yacht Club – Onboard Wi-Fi Terms of Service

Effective Date: July 1, 2026

By purchasing, accessing, or using the SeaDream Yacht Club onboard Wi-Fi service (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Service Availability

The Service is provided via satellite internet, including Starlink and other providers that may change from time to time. Because satellite communications operate under conditions beyond SeaDream's control, internet performance may vary.

You acknowledge that:

- Internet speeds, latency, reliability, and coverage may vary.
- Service may be affected by weather, sea conditions, satellite coverage, geographic location, network congestion, maintenance, technical issues, or regulatory restrictions.
- The Service is not intended to provide the same performance or availability as a land-based broadband connection.
- Temporary interruptions or outages may occur without prior notice.

While SeaDream strives to provide the best possible onboard internet experience, uninterrupted or error-free service cannot be guaranteed.

2. Third-Party Network Providers

SeaDream provides onboard access to the internet through third-party telecommunications and satellite service providers, including Starlink and other providers that may change from time to time.

The availability, performance, routing, and coverage of the Service depend in part on these third-party providers and their infrastructure, which are outside SeaDream's reasonable control.

SeaDream is not responsible for service interruptions, delays, outages, routing decisions, or other limitations resulting from third-party providers.

Third-party providers may maintain their own terms of service and privacy policies, which are available on their respective websites.

3. Acceptable Use

The Service is intended for lawful use by registered guests.

You agree not to:

- violate any applicable laws or regulations;
- infringe copyrights, trademarks, or other intellectual property rights;
- download, upload, or distribute illegal or pirated content;
- transmit malware, ransomware, viruses, or other malicious software;
- engage in hacking, phishing, denial-of-service attacks, network scanning, password attacks, or attempts to gain unauthorized access to any systems or networks;
- send spam or other unsolicited bulk communications;
- attempt to bypass authentication, bandwidth controls, traffic management, or security measures;
- interfere with the operation, security, or performance of the Service or other users' access.

SeaDream reserves the right to suspend or terminate access for activity that violates these Terms or threatens the security, stability, or operation of the network.

4. Fair Use and Traffic Management

To provide a reliable experience for all guests, SeaDream may employ reasonable network management practices.

These may include:

- bandwidth limits;
- traffic shaping;
- prioritization or deprioritization of certain traffic;
- temporary speed reductions during periods of heavy demand;
- restrictions on unusually high-bandwidth activities, including large file transfers or continuous high-definition streaming.

SeaDream may also block or restrict traffic, applications, protocols, or devices that present security risks, violate these Terms, or materially affect the experience of other guests.

5. Device Compatibility and Guest Responsibilities

Guests are responsible for:

- ensuring their devices are compatible with the Service;
- maintaining current operating system and security updates;
- using appropriate passwords and device security;
- protecting their own information through encryption, VPNs, antivirus software, firewalls, or other appropriate security measures where desired.

SeaDream is not responsible for the security, configuration, compatibility, or operation of guest-owned devices.

6. Privacy, Security, and Network Monitoring

SeaDream respects guest privacy while maintaining a secure and reliable onboard network.

To authenticate users and to operate, secure, maintain, troubleshoot, improve, and protect the Service, SeaDream may collect and process technical information relating to network usage, including:

- device identifiers (such as MAC addresses);
- IP addresses;
- authentication records;
- connection times and session duration;
- bandwidth usage;
- network performance metrics;
- destination domains or IP addresses where technically available;
- diagnostic and security logs.

This information may be used for:

- network administration;
- security monitoring;
- fraud prevention;
- abuse detection;
- malware detection;
- capacity planning;
- quality assurance;
- troubleshooting;
- compliance with applicable laws and lawful requests from governmental authorities.

SeaDream does not routinely monitor or inspect the contents of guests' communications.

Because internet traffic may be routed through third-party providers and infrastructure located in multiple jurisdictions, data transmissions may be processed outside the country in which the vessel is located.

Guests should understand that the internet is a public network. While SeaDream takes reasonable measures to protect its systems, no internet connection can be guaranteed to be completely secure or confidential.

7. No Warranty

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by applicable law, SeaDream disclaims all express or implied warranties, including warranties of:

- uninterrupted availability;
- merchantability;
- fitness for a particular purpose;
- performance;
- reliability;
- speed;
- accuracy;
- security.

8. Charges and Refunds

By purchasing Wi-Fi access, you confirm that:

- you are a registered guest;
- you are authorized to charge the selected stateroom's onboard account;
- the displayed purchase price has been reviewed before confirming the purchase.

Except where required by applicable law, Wi-Fi purchases are non-refundable once access has been activated, including where performance is affected by satellite connectivity, weather, sea conditions, geographic location, network congestion, equipment failures, or other circumstances beyond SeaDream's reasonable control.

9. Changes, Suspension, and Termination

SeaDream may modify, suspend, restrict, or terminate the Service or these Terms where reasonably necessary for operational, security, legal, safety, or technical reasons.

SeaDream may immediately suspend or terminate a guest's access without refund if:

- these Terms are violated;
- applicable laws require such action;
- continued access threatens the security or operation of the network;
- misuse materially affects other users.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SeaDream shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:

- use of the Service;
- inability to access the Service;
- interruptions or delays;
- reduced performance;
- loss or corruption of data;
- unauthorized access to information;
- business interruption;
- loss of profits;
- or any other damages arising from use of the Service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

11. Circumstances Beyond Our Control

SeaDream shall not be responsible for any interruption, degradation, or unavailability of the Service resulting from circumstances beyond its reasonable control, including:

- satellite service interruptions;
- failures of third-party telecommunications providers;
- weather or sea conditions;
- governmental actions or restrictions;
- cyberattacks;
- power failures;
- equipment failures;
- maintenance;
- force majeure events.

12. Governing Law

These Terms shall be governed by the governing law specified in the applicable SeaDream Yacht Club Passenger Ticket Contract, except where mandatory consumer protection laws require otherwise.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
